TERMS OF USE AND PERSONAL DATA PROTECTION

INTRODUCTION

These terms of use (hereinafter the “Terms”) apply to all natural or legal persons who use Collections (the “User” or “you”). Their purpose is to define the terms and conditions under which:

  • The Website, via Collections, connects Users (who must be members of the ALL - Accor Live Limitless loyalty programme) with all legal persons who sell products as part of their professional, commercial or manufacturing activity (“Partner(s)”), and
  • Users access Collections and can consult the offers from Partners that make it possible to earn Reward Points (as defined in the Terms of Membership of the ALL - Accor Live Limitless loyalty programme).

Accessing or browsing Collections presupposes your unconditional acceptance of these Terms. You have the option of downloading and printing these Terms by using the standard functionalities of your browser or computer.

Purchasing products or services via Collections also presupposes your acceptance of the Terms of Membership of the ALL - Accor Live Limitless loyalty programme.

1. LEGAL NOTICES

The Collections website ("Collections" or the “Website”) is published and hosted by Valuedynamx Limited, which has its registered office at: Cutlers Exchange, 123 Houndsditch, London, EC3A 7BU, UK. Registration number: 6708136. It is registered in England and Wales.

2. SERVICES OFFERED BY COLLECTIONS

2.1. Access to Collections

Collections is accessible free of charge to all Users, regardless of location, who have internet access, in the knowledge that the offers that are available on Collections are exclusively reserved for Users who are members of the ALL - Accor Live Limitless loyalty programme.

In this respect, the expenses incurred by the User in order to access Collections (computer hardware, software, internet connection, etc.) shall be paid by the User.

Collinson endeavours to provide access to Collections 24/7, except in the case of force majeure, as defined in Article 7 of these Terms or an event that is beyond the control of Collinson, subject to any maintenance work that is necessary for Collections to operate correctly, and subject to any breakdowns and problems associated with the telecommunications networks.

Collinson may have to suspend access to all or part of Collections, at any time, without this entitling the User to any compensation.

Collinson cannot be held liable if it is impossible or difficult to access all or part of Collections.

2.2 Membership of Collections

One single Collections account (Account) is authorised per person and Points can only be earned on one account per person.

If an account remains inactive for a period of more than 12 months, we are entitled to close it.

The Website is reserved solely for use by private individuals and is not intended for trade purchases. If we suspect that an Account is being used for anything other than personal use, we are entitled to cancel the membership.

If we suspect fraudulent or suspicious activity, we reserve the right to block an Account, to suspend transactions and/or to cancel the membership.

2.3 Offers available on Collections

2.3.1 Presentation

The purpose of Collections is to make it possible for Users to access the Partners’ products and to earn Reward Points for each euro spent on the Partner’s site, in accordance with the terms set forth in the Terms and the summary page that is specific to each Partner (“Partner Page”). In order to be able to earn Points, Users must first log in to their Collections account using their ALL - Accor Live Limitless member number and password and access the Partner site via the Collections portal in order to make their purchases.

Collinson does not sell the Products shown in Collections, but merely acts as an intermediary for the promotion, via the Website, of the selected Partners so that Members can connect with the Partner (by clicking on the link that redirects to the Partner’s website).

All orders for goods or services that are initiated by you create a contractual relationship with the participating merchant and not with us. The purchase of goods or services from participating merchants is subject to their terms and conditions of sale. If you have complaints concerning the goods or services that were supplied to you, delays or any other problems regarding delivery, these matters must be resolved in agreement with the merchant and not with us. We do not offer any warranty concerning products or services that you have purchased from participating merchants, and we expressly exclude all representations and warranties, including those concerning compliance with the intended use, the marketable quality and/or the adequate quality of the goods and/or services purchased from the Website’s participating merchants.

For each product or service ordered, the Partner’s terms and conditions shall apply. For each order, the User is required to pay all the customs duties, all the taxes and all the customs clearance costs if they are applicable to the destination.

Participating merchants pay us commissions. We choose to feature merchants based on seasonal popularity (the likelihood of retailers to attract purchasers) and the commission rate.

2.3.2. Procedure & requirements for awarding Points

When you purchase goods and/or services through a third party retailer advertised on this Site you will be entitled to earn Reward Points, as long as you have logged into your ALL - Accor Live Limitless account on all.accor.com or collections.accor.com.

Reward Points are only awarded on purchases made online with third party retailers featured on the Collections website via the 'Shop now” button, shown when you are logged into your account on the Collections partner page on all.accor.com

Reward Points will not be awarded on the purchase and/or the use of gift vouchers, which for avoidance of doubt includes gift cards, gift certificates or any other similar cash equivalents, or on taxes and/or delivery charges.

We reserve the right to cancel any Reward Points awarded to you in respect of a purchase which you subsequently cancel (i.e. if you didn't pay for or later returned the goods and/or services for which the points were awarded).

In order to earn points the shopping transaction needs to be in the name of the ALL - Accor Live Limitless member.

As a User of the ALL - Accor Live Limitless programme, you will receive Points from the merchants that are present on our Website. We will make every effort to ensure that the Points offered are advertised correctly.

The number of Points that a User can earn by purchasing products or services via Collections is displayed on Collections. Points are earned on the value of the product or service purchased, not including taxes and shipping costs. These Points are Reward Points within the meaning of the Terms of Membership of the ALL - Accor Live Limitless programme.

You must be registered on this Website and use our links to participating merchants in order to be eligible to earn Points. You cannot earn Points for purchases that you made before registering on the Website.

Reward Points will not be credited immediately. You will become eligible to earn Reward Points once the participating merchant has confirmed and approved the purchase. This process depends entirely on the merchant. ACCOR must obtain confirmation of the transaction from the Partner before granting it “Approved” status and crediting the Reward Points to the User’s account. For most Partners, this procedure can take 45 days and is subject to the Partner’s Terms and Conditions (for some merchants it will take longer). Depending on the timeframes policy applied by the merchant, it can take up to 45 days to obtain this confirmation. Once the order has “Approved” status, the Reward Points will be credited to the User’s account within twenty-four (24) hours.

Users can cancel purchases and be reimbursed, as permitted by the Partner’s terms and conditions of sale. On the other hand, if the transaction is ultimately reimbursed or cancelled, no Points will be earned. If a User cancels a purchase after the Reward Points have been credited to his/her ALL - Accor Live Limitless account, ACCOR reserves the right to deduct these points from the User’s account.

The Points have no cash equivalent, except in the cases defined by these terms of use.

Points can only be earned on the net value, excluding VAT and all other taxes, surcharges and additional costs, such as shipping costs.

2.3.3. Monitoring of transactions

Transactions are monitored electronically and are reported by participating merchants. We cannot be held liable if, for any reason whatsoever, merchants do not report the sale to us correctly or do not contact us at all. We will however make all reasonable efforts to guarantee correct reporting by participating merchants. We nonetheless cannot be held liable if the merchants fail to do so.

All transactions involving participating merchants are tracked using cookies. It is your responsibility to ensure that cookies are activated in your browser and that no security software installed on your computer blocks cookies.

2.3.4. Customer service

Any claim for missing Reward Points must be made to us in writing within 90 days of your purchase. All claims are resolved by us at our sole discretion.

3. CHANGES MADE TO THE WEBSITE AND TO THE TERMS OF USE

The Terms shall apply throughout the period during which the Website is available online.

The content of this Website and of these Terms may be amended at any time at our sole discretion. There is no obligation to notify these changes individually to Users of the Website; the User is therefore advised to refer regularly to the latest version of the Terms, which is available on the Website at all times. If changes are made, a new version of these conditions will be available here. We advise you to consult this section regularly, even if you have no intention of making a purchase.

4. COPYRIGHT

This website is protected by copyright. The software is our exclusive property and we retain all rights, titles and interests concerning and to the software throughout the entire world, including all modifications and improvements concerning said software.

5. LIABILITY LIMITATION

The information available on Collections is presented and offered to the Users in complete good faith.

Users who wish to use the Website do so solely at their own risk.

We cannot be held liable for any malfunctions, no matter how slight:

  1. that affect this Website
  2. or the communication system that connects us to you, regardless of the type and regardless of the reason, which is beyond our reasonable control.

We may not be held liable for unauthorised operations of any kind whatsoever involving your Account.

We reserve the right to modify, suspend or close Collections for any reason and without having to provide any explanation.

Collinson may at any time and without giving notice change the participating Partners or terminate their contracts; in these cases, Users will no longer be able to earn Reward Points when making purchases on the websites of former Partners.

Collinson cannot be held liable for any suspension or inaccessibility of Collections, for any occurrence of bugs or for any damage that results from fraudulent acts committed by third parties.

You acknowledge that you have taken all requisite steps to protect your hardware and your data, in particular against all infection by viruses and all other computer malware.

You are responsible for your use of hypertext links that are published on Collections. Collinson accepts no liability with regard to websites that direct to Collections and their contents, or that are linked thereto.

Websites that are external with regard to Collinson and that have a hypertext link to Collections, including the Partners’ websites, are not under Collinson’s control. Consequently, Collinson accepts no liability concerning their content.

Collinson accepts no liability for the loss or theft of goods or vouchers exchanged via Collections, or for any damage that affects said goods or vouchers.

The Website and the Partners’ websites are not under ACCOR’s control; ACCOR cannot be held liable in any way.

6. PERSONAL DATA

  1. Accor (the Data Controller) and Valuedynamx Limited understand and respect your desire for privacy. The processing of data within the framework of the Site will comply with the ACCOR Charter Customer Personal Data Protection Charter
  2. For all Users of this Website, our Internet server does not automatically recognise any information concerning domain names or e-mail addresses. All the information we collate:
  1. Is used to improve the content of this Website;
  2. Is used to adapt the content and/or the presentation of this Website to each individual visitor;
  3. Is used to send notifications to users concerning updates to this Website;
  4. Is used by us to contact users for marketing purposes.
  1. Concerning e-mail address data
    E-mail address data is only collated when a User communicates with us via e-mail. If you do not wish to receive information from us via e-mail, please let us know by contacting us.
  2. Third-party websites
    We are not responsible for the content or privacy policies of the websites that direct to the Collections Shopping websites or, conversely, of the websites to which it directs.
  3. Concerning telephone number data
    Persons who provide us with their telephone number online will only be contacted by us via telephone concerning orders they have placed online.
  4. Concerning cookies
    We use cookies to record visitors’ preferences and the history of activities, in order to provide better services to Users who return to this Website.
  5. Concerning security
    We have always used standard encryption technologies in our sector of industry when we transfer and receive consumer data in connection with this Website. We have implemented appropriate security measures in our physical facilities in order to protect against the loss, wrongful use or falsification of the data that we have collated concerning you on this Website. This data includes financial information (data concerning the credit card account, for example), personal identification information (the customer number or password, for example), information concerning transactions (the dates on which customers made their purchases, the amounts and the type of purchase, for example), communications by consumers/visitors to this Website (e-mails and requests from customers, for example), and contact data (the name, address and the telephone number, for example).

8. LANGUAGES

Collections is available in English and French. As the French-language version is authentic and authoritative, in the event that Collections is translated into a foreign language, the French-language version shall take precedence over any other translation in the event of a disagreement, dispute or difficulty in construing or fulfilling these terms and, more generally, concerning the relations that exist between the parties.

9. SEVERABILITY

If one or more provisions of these Terms are found to be invalid or declared as such pursuant to a law, a regulation or following an unappealable decision handed down by a court with jurisdiction, the other provisions shall retain their full force and scope.

10. APPLICABLE LAW AND CHOICE OF FORUM

These Terms of Use are governed by French law, without prejudice to the mandatory rules of law of the country in which the User is located.

The French courts shall have exclusive jurisdiction to resolve all disputes concerning the application, the construction and the performance of the Terms.
